Prison sentence on new theft charge

McCOOK, Neb. -- A local thief sentenced to probation in 2014 for stealing tools off commercial vehicles, as well as a rifle and a shotgun from two unrelated victims and other items, received prison time earlier this month after he was arrested again on new charges.

The offender, 23-year-old Patrick Brooks of 1006 West 12th Street, was sentenced to 36 to 60 months in state prison on the 2014 conviction after his probation was revoked in Red Willow County District Court. He was also sentenced to a consecutive 180 days in jail on a new theft conviction.

Brooks was originally ordered to serve 30 months probation in November of 2014 after accepting a plea agreement admitting guilt to a Class III felony burglary offense; a Class IV felony offense for theft by unlawful taking; and two Class I misdemeanor offenses for possession of stolen property. In October of 2015 an arrest warrant was issued for Brooks on new felony charges alleging child abuse and theft by receiving stolen property, as well as a misdemeanor offense for false reporting.

Red Willow County Attorney Paul Wood subsequently pursued a Class IV felony alleging theft by receiving stolen property valued between $1500 and $5000. Brooks accepted a plea agreement in August of 2016 reducing the value of the stolen property to between $500 and $1500, a Class I misdemeanor. He was sentenced on Feb. 6, 2017, and ordered to serve 180 days in jail with the sentence to be consecutive to his sentence on the probation violations.

Brooks 2014 probation was subsequently revoked and he received a 36-60 month sentence with the Department of Corrections, stemming from the original Class 3 felony burglary conviction. He received concurrent 12 month sentences on two of the other convictions, as well as a concurrent 12-36 month sentence on the Class IV felony theft conviction. He also received credit for 39 days already served.

Other activity in Red Willow County District Court, Feb. 6, 2017:

* A McCook woman, 29-year-old Jessica R. Shafer of 801 East 5th Street, pleaded not guilty to a Class 3A felony alleging drunk driving with two prior convictions. Shafer was subsequently scheduled for a status hearing at 1 p.m. on April 3, 2017.

* A plea agreement was reached with a McCook man reducing a Class IV felony alleging theft by receiving stolen property valued between $1500 and $5000, to a Class I misdemeanor for theft by receiving stolen property valued between $500 and $1500. The thief, 23-year-old Patrick Brooks of 1006 West 12th Street,

* A McCook woman, 47-year-old Sheila K. Sain of 1002 East B Street, pleaded not guilty to a Class IV felony alleging possession of methamphetamine and an infraction alleging possession of drug paraphernalia. A motions hearing was subsequently scheduled at 2:30 p.m. on March 6, 2017.

* A pair of criminal cases filed against 35-year-old Mindi Y. Relaford of Bartley were continued until 1 p.m. on April 3, 2017. Relaford is facing a Class IV felony alleging theft by unlawful taking ($1500-$5000) and a Class 3 misdemeanor alleging she was driving under suspension in one case. The second criminal case includes a Class 3A felony alleging DUI (.15+ with two prior convictions), a Class 3 misdemeanor alleging she refused to submit to a chemical test and a misdemeanor alleging she refused a preliminary test.
